3D Scan Metascan S.L. Academic Licence Agreement

This document states the terms and conditions of the Academic Licence agreement ("Licence") by Metascan between the researcher ("You") and Metascan. Use of the 3D models and scans on the Metascan shop website is conditional upon your agreement to the terms and conditions set out below. If you do not agree to these terms, then you must not accept the terms hereof or purchase, download, access or otherwise use any products from Metascan.

General Allowed Uses

Without prejudice of the restrictions stated below the license provides access to the metascan 3D models solely with academic purposes under the representation of an academic institution.

Intellectual Property

All materials including the organization and presentation of these materials on the Metascan shop website are the property of Metascan and are protected by intellectual property laws.

Conditions of Use

• Use of the scan or model for personal projects, anatomical study or portfolio work.
• 3D printing of the scans for academic and research projects.
• Use in any academical non commercial personal project.

Accessing an Academic Licence Does NOT Allow For:

• Resale of the scan or derivative of the scan in any 3D format.
• Using the scan data or any derivative of the data within a commercial product or project.
• Promotion of a commercial product or project.
• Use within a company for research and development of a commercial project such as a game / film or tutorial (please purchase an R&D licence).
• Integration of our scan data into any character maker programme whereby the results can be exported as 3D models in any 3D format. Including but not limited to Daz 3D.
• Use the 3D models or scans to train any models or provide raw data for investigations that have further commercial purposes or imply personal profit.
• Sell or distribute any of these 3D Models or Scans in an unmodified form, or where the derived product you are selling or distributing is a 3D model or Scan or a collection of 3D models or scans, alpha or texture packs. IN OTHER WORDS: Do not sell or distribute any of these 3D models or scans (modified or not) by itself, as part of a character maker programme, 3D model, or material / texture packs derived from scans on this site.
• Resell any 3D models or scan as a 3D printed figure or anatomy model either printed or cast.
• Bundle the 3D models or scans with software such as 3D programs, photo-kiosk software.
• Reselling or redistributing the 3D Scans or models at 'print on demand' services (mugs, t-shirts, mouse mats, etc).
• Sell or freely distribute character generators or digital humans created using AI training data derived from 3D scan store models, scans or texture maps.
• Use commercially or for profit a free download or giveaway 3D Models or scans without expressed permission.
• Release the 3D models or scans or derivative products under Open Source Licences.
• Use any 3D Scan purchased from this shop commercial or non commercial licence to produce an online / offline anatomy / photography viewer.
• Use 3D scans or models to create pornographic materials or other illegal visual materials including but not limited to violent material, fake news.

Privacy

Metascan respects the privacy of the personal information of the individuals with whom we interact. Metascan does not disclose personal information of our members or those individuals who visit our website. No newsletters or offers will be sent to you without your prior consent. Any information submitted by the buyer will be used solely for the purpose of completing the transaction, delivering the product and addressing any customer service issues.

Limitation of Liability

You assume all responsibility and risk for the use of the 3D scan store website, the 3D models, scans, materials and information. Your use is to be done within the limitations of the GDPR, LO 3/2018 and all the binding legislation.

Metascan does not represent or warrant that the site or any content available for downloading through the site will be free of viruses or similar contaminations of destructive features.

In no event shall 3D scan store or any of its affiliates, employees or Contributors be liable for any incidental, indirect, punitive, exemplary or consequential damages whatsoever, including damages for loss of profits, interruption, loss of business information, loss of data, or any other pecuniary loss in connection with any claim, loss, action, suit, damage or other proceeding arising under or out of this licence, including without limitation your use of, reliance upon, access to or exploitation of the 3D scan store website, the materials or any part thereof, or any rights granted to you hereunder, even if we have been advised of the possibility of such damages, whether the action is based on contract, tort (including negligence), infringement of intellectual property rights or otherwise.

Indemnification

You agree to indemnify and hold 3D scan store harmless against all claims or liability asserted against 3D scan store arising out of or in connection with any breach by you or anyone acting on your behalf of any of this licence.

General

This licence shall be governed by and construed in accordance with the laws of Spain with special observance to the GDPR, LO 3/2018 and all the binding legislation. Any contravention of the applying legislation by the user ("You") shall not be the responsibility of Metascan and therefore no liability could be demanded. The parties consent to the exclusive jurisdiction of the courts of, and venue and situs in Spain.

Termination

3D scan store reserves the right to terminate the licence of the use of the materials on 3D scan store if the user is found in breach of this licence and does not remedy that breach within three (3) days of receiving notice from 3D scan store.
